§ 22-194. Parking restricted in parking spaces signed as reserved for use by disabled persons.

  • (a)

    No person shall park a vehicle in a parking space on public or private property within the City of Miles City that is clearly identified by an official sign as being reserved for use by a person with a disability unless:

    (1)

    The vehicle is lawfully displaying a parking permit issued under §49-4-301 MCA, a distinguishing license plate or placard for a person with a disability that was issued by a foreign jurisdiction conferring parking privileges similar to those conferred in §49-4-302(1) MCA, or a specially inscribed license plate issued under §61-3-332(10)(c)(i)(A) displaying the letters "DV" or purple heart decal, or under §61-3-332(10)(g) MCA displaying the wheelchair symbol, or a comibned plate issued under §61-3-426(2) MCA and inscribed with the design or decal provided for in 61-3-332(10)(c)(i)(A) MCA or §61-3-332(10)(g) MCA; and

    (2)

    The reserved parking space is being used by the person for whom the permit, plate, or placard was issued to enter or exit the vehicle.

    (b)

    An "official sign" for purposes of this section shall mean a sign having the international accessibility symbol, indicating that a permit is required and stating the penalty ($100.00 fine) for violation. Such signs shall be placed upon a public street, public boulevard or other public property only pursuant to the authorization of the director of public works for the city.

    (c)

    A person who parks a vehicle in violation of this section is guilty of a misdemeanor and is punishable by a fine of $100.00. However, a person charged with violating subsection (a)(1) may not be convicted if within 24 hours the person produces in court or the office of the arresting officer a special parking permit that was issued to the person and that is valid at the time of the arrest.
