§ 20-136. Form.

  • Whenever sidewalks and curbs are ordered to be constructed in front of any lot or parcel of land without the formation of a special improvement district, and the property owners fail and neglect within the time provided by law to construct such improvements, the city may construct or cause to be constructed such improvements and issue special warrants as described in this article for the payment of the work done or improvements made. Such special warrants shall be drawn against and shall be payable from a fund to be known as a special sidewalk and curb fund, and shall bear a fixed annual percentage rate. Such interest shall be payable annually and at such time as may be stated in such warrant, and such special warrant shall be in the following form and language:

    Issued by the City of Miles City, Montana.

    The Treasurer of the City of Miles City, will pay to ___________ or bearer, the sum of _______ dollars, as authorized by Resolution No. _____ as passed on _____ day of _______, A.D. ___, ordering sidewalks, and curbs, to be constructed in front of the property therein described and which were constructed or caused to be constructed by the City of Miles City, upon the failure of the property owners so to do, within the time prescribed by law. The principal and interest of this warrant are payable at the office of the City Treasurer of the City of Miles City, Montana.

    This warrant bears interest at the rate of _____ percent per annum from the date of registration of this warrant, as expressed herein, until the date called for redemption by the City Treasurer. The interest on this warrant is payable annually on the first day of January, of each year, unless paid previous thereto and as expressed by the interest coupon hereto attached, which bears the engraved facsimile signatures of the Mayor and the City Treasurer and is attested to be the City Clerk.

    This warrant is payable from the collection of a special tax or assessment which is a lien against the real estate as described in said resolution hereinbefore referred to in this warrant.

    This warrant is redeemable at the option of the City of Miles City at any time there are funds to the credit of said special sidewalk and curb fund for the redemption thereof and in the manner provided for the redemption of the same; provided, however the date of payment shall not exceed _____ years from and after the date of issuance. It is hereby certified and recited that all things required to be done precedent to the issuance of this warrant have been properly done, happened and been performed in the manner prescribed by the laws of the State of Montana and the resolutions and ordinances of the City of Miles City, Montana, relating to the issuance thereof.
